Khir the ineffective executive

This dentist-turned politician of humble beginnings has absorbed only too well the Sultan Syndrome, enjoying the trappings of his office but is otherwise clueless about being an effective executive.

The remarkable aspect to the whole shenanigan is the curiously “uncurious” Khir Toyo. As the state’s chief executive, I would have expected him to be demanding answers from the Council officials. Alas we now have the sultan having to take that highly unusual initiative.

“Khir Toyo, who is also in-charge of land and financial Matters in the state executive council, was not transparent and had allowed the awarding of land to Umno leaders and their families without ensuring they were eligible,” said Shamsul.

He also made the following allegations:

  • Presence of elements of corruption in the land allocation issue in the interest of individuals;
  • Abuse of power when status of land meant for temporary occupation (TOL) and for construction of religious school was converted and sold to Zakaria’s wife, Datin Zizah Ngah;
  • Non-disclosure on the criteria of awarding the land to Zizah and how it had benefited the state and the public; and
  • Abuse of power when the state government offered the land to Zizah at a discounted rate.

Time to reintroduce municipal and city council elections

The Bar Council says it would be timely for the government to reintroduce municipal and city council elections.

“The present system of appointment of councillors to local governments cannot continue. Such practices have time and again proven to have been manifestly abused,” said its president Yeo Yang Poh said in a statement today.

He said municipal elections, as practiced in many jurisdictions, provided direct accountability and its restoration and implementation should not be delayed.

Khir says government is selective in enforcement because it is friendly

Let’s be realistic – there are a lot of buildings in Selangor built without proper local council approval. That is the frank opinion of Selangor Mentri Besar Datuk Seri Dr Mohd Khir Toyo. 

“I have been told I must be fair; to act without fear or favour. If so, then these properties and building extensions are also subject to demolition,” Dr Khir told reporters yesterday. 

“Such properties include temples and even the headquarters of political parties. If I go strictly by the book instead of taking into account public interest and racial harmony, imagine the outcry if I were to execute the demolition orders.” 

Dr Khir said his state government has long known about the existence of many properties, building extensions and even 5,000 factories constructed without obtaining all the approvals from local councils. 

However, he said, enforcement action had been selective because the state wanted to be a friendly government, and not execute drastic measures that might cause hardship for the rakyat.

Nazri says ACA cannot investigate political corruption or money politics

Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz had told The Star in an interview recently that the ACA cannot investigate political corruption or money politics in party elections because these offences were confined to the party and thus were not public transgressions. 

He said the parties had their own mechanisms such as the disciplinary board or committee to handle such misdemeanours, and that the ACA could not come in because the offences had nothing to do with the public.

ACA can investigate money politics

The Anti-Corruption Agency (ACA) can investigate money politics in any party election as the law on corruption applies to everyone including political parties, said a prominent lawyer who deals with corruption cases. 

Christopher Fernando stressed that nobody was immune, not even political parties. 

The law overrides all domestic mechanisms. You can’t override the law. No political party can come up with their own regulations or disciplinary procedures to override the law

“The Anti-Corruption Act (1997) applies equally to public officials and private individuals. Clearly, if someone offers a bribe during a party election, that’s corruption. 

“It can be in the form of a bribe or a gratification for doing a favour. Anything of monetary value or anything that gives pleasure is a gratification. These can be gifts, a holiday, a trip to the spa, entertainment or women. All these comes within the ambit of the Act,” he said.
